SHANTI BARCLAY

Shanti has focused on building an insurance defence practice in property and product liability loss, including subrogation. She has worked extensively on files involving Construction, Tarion and Builder’s Risk, dealing with; fires, floods and oil spills, including large losses arising from train derailments. She is an Appraiser under s.128 of the Insurance Act and has successfully obtained Injunctions under the Environmental Protection Act. Shanti consistently represents Long Term Care Facilities and frequently represents health care professionals including; Personal Support Workers, Nurses, Optometrists and Dentists. She has years’ experience defending Professional Negligence claims, including Chartered Accountants and Engineers. Since being called to the bar, she has worked on a number of Class Actions in areas ranging from Pollution, Privacy Breach, Explosions to Personal Injury; including the use of restraints in mental health hospital wards and COVID-19 transmissions. She has represented domestic insurers to pursue civil remedies in fraud and continues to grow her current portfolio working for Lloyd’s of London syndicates.

Shanti co-chairs the firm’s Property, Subrogation, Health Law, Class Action, and Product Liability groups. Since 2022, Shanti has been recognized by her peers for inclusion in the Best Lawyers of Canada list in the area of Insurance Law. Shanti’s advocacy skills cross a wide range of judicial proceedings. She has appeared before several tribunals and all levels of court including: the Ontario Court of Appeal, the Ontario Divisional Court, the Ontario Superior Court of Justice, the Court of King’s Bench of Manitoba, the Court of King’s Bench of Alberta and the Federal Court of Canada. She has successfully defeated applications for leave to the Supreme Court of Canada.

Shanti received her Bachelors of Arts in Political Science at York University and completed law school at Osgoode. After articling at a well-known defence law firm, she was called to the bar in 1998. Since then, she has built a large team of assistants, law clerks and lawyers dedicated to client focused practice groups which prioritizes principled, economic and creative claim resolution solutions.

While Shanti promotes early settlement, she thoroughly enjoys being in court.

When she is not working, she spends time between her four children and her yoga mat.
